The introduction of e-conveyancing is, without question, an ambitious and innovative programme of work.
The aim of the programme is to make conveyancing easier for all; specifically to develop an electronic system that makes buying and selling property easier and less stressful for the public, conveyancing professionals and other parties involved in the process.
E-conveyancing will transform the way Land Registry delivers its current services and will introduce new services to new customer groups. However, it will do more than this; it will transform the conveyancing process and change forever the way conveyancers provide conveyancing services to their clients.
The Land Registration Act 2002 (the Act) provided the legislative framework to enable the implementation of e-conveyancing services. Since the Act came into force we have been developing our e-conveyancing proposals and drafting the secondary legislation required to give effect to the provisions contained in the Act. However, we realise that conveyancing involves extremely complicated processes that cannot easily be converted from paper into an electronic system. This is the first part of our consultation on the secondary legislation required to operate an e-conveyancing system. It contains our proposals for The Land Registration (Network Access) Rules 2007 andThe Land Registration (Electronic Communications) Order 2007. Although our object is to consult on the proposed rules, we do not feel that we can explain their effect without placing them in the context of the overall e-conveyancing picture. We have therefore provided an overview of all of our proposals for an e-conveyancing system, together with a draft, and at this stage necessarily incomplete, network access agreement.
